Release of Liability & Waiver of Claims

I hereby voluntarily submit this Release of Liability / Waiver of Claims on my own free will. I acknowledge that my use of the spa Circuit is entirely optional and not a requirement of Circle Wellness Granville Island. I understand that I should read this Agreement carefully in its entirety before signing and I am giving up my right to sue.

I acknowledge that the amenities within the spa Circuit at Circle Wellness Granville Island include an open-air shower, deep cedar hot soaking tub, multi-sensory infrared sauna featuring Himalayan salt walls, cold water plunge, hot water at tea station and heated river stones.

WELLNESS ACKNOWLEDGMENT

I affirm that I am currently in good physical and emotional health, and I have no known history of conditions that would impede my ability to utilize the spa Circuit at Circle Wellness Granville Island in a safe manner. It is my personal responsibility to assess the risks associated with my use of the spa Circuit at Circle Wellness Granville Island. I am the ultimate judge of whether I can use the spa circuit safely without harming myself.

I also acknowledge that a spa Circuit session at Circle Wellness Granville Island is not recommended under the following conditions:

  • During pregnancy.
  • After recent (acute) joint injury, within the first 48 hours or until swelling subsides.
  • In cases of severe allergies to salt or cedar wood.
  • For individuals with hemophilia or a predisposition to hemorrhaging/bleeding.
  • For individuals with conditions that reduce the ability to sweat; consulting a physician is advisable for those on medication affected by elevated body temperature.
  • Individuals using prescription drugs should seek advice from their personal physician or pharmacist regarding potential effects when exposed to infrared waves or elevated body temperature.
  • Use caution if taking diuretics, barbiturates, beta-blockers, or over-the-counter antihistamines, as they may affect the body’s natural heat-loss mechanisms.
  • For the elderly, aging can reduce the ability to regulate core body temperature.
  • Individuals with cardiovascular conditions or those taking medications that may affect blood pressure should exercise caution when exposed to prolonged heat, as it can increase cardiac output and blood flow.
  • Attempting to “sweat out” a hangover is not advisable, as alcohol can impair judgment and increase heart rate, potentially leading to adverse reactions to heat.
ASSUMPTION OF RISK

I understand and expressly assume all responsibility for any potential risks associated with using the spa Circuit and the entire facility at Circle Wellness Granville Island. I understand and acknowledge that the use of the spa circuit and any cosmetic or skincare products provided or made available may involve the risk of sustaining serious injury, falls, burns, disability, allergic reactions or death. I understand that the spa circuit at Circle Wellness Granville Island may not be supervised and that Circle Wellness Granville Island does not provide medical services. I further acknowledge that any injury I may sustain while engaged in the spa Circuit may be compounded by negligent or delayed medical service.

FACILITY USE

I understand that I am personally liable for any damages, deterioration, or loss of use of the facility, its systems, and contents, resulting from my use of the spa Circuit for any reason. I understand that if property is lost, stolen or damaged as a result of my use of the spa Circuit, I will be responsible for covering the associated charges.

THIRD PARTY PHOTOGRAPHY, DRONES & GUEST PRIVACY

I understand that any decision to disrobe during the course of services provided by Circle Wellness Granville Island is entirely voluntary and at my sole discretion. Circle Wellness Granville Island expressly disclaims any and all liability arising from my choice to disrobe.

Granville Island prohibits the use of drones; however, Circle Wellness Granville Island has no control over third-party individuals or entities who may capture images, videos, or drone footage. I hereby release, waive, and hold harmless Circle Wellness Granville Island, its owners, employees, contractors, and affiliates from any and all claims, demands, or causes of action arising out of or related to any third-party media or drone activity, including the creation, use, or dissemination of any such images or recordings.

RELEASE

I hereby agree, on behalf of myself, my heirs and my personal representatives, to fully and forever discharge and release Circle Wellness Granville Island and its affiliates, partners, agents, operators, managers, employees and representatives from ALL CLAIMS, whether currently owned or future, including those related to personal injury, property damage or destruction, and death. This release covers all causes of action, whether they arise from negligence by any party, breach of contract, or any other reason, and whether they pertain to bodily injury, property damage, or loss. I acknowledge and agree that this release is intended to be, and is, a complete release of any responsibility of Circle Wellness Granville Island for any and all personal injuries, loss, disability or death sustained by me while on or using the spa Circuit. I acknowledge and agree that this release is intended to be, and is, a complete release of any responsibility of Circle Wellness Granville Island for any and all personal injuries, loss, disability or death sustained by me while on or using the spa Circuit.

I have carefully read, fully understood, and voluntarily agreed to the terms of this Release of Liability / Waiver of Claims. I acknowledge that Circle Wellness Granville Island makes no representation as to the condition of the spa Circuit or the safety of any structures or equipment that may be used at Circle Wellness Granville Island. I acknowledge and agree that I am not relying on any representation or statement by Circle Wellness Granville Island or its employees, agents or representatives regarding this agreement or the spa Circuit except to the extent such representations are expressly set forth in this agreement. If any provision or portion of this agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. I acknowledge that my signature serves as a complete and unconditional release of all liability to the greatest extent allowed by law in the Province of British Columbia, Canada.

By signing this waiver, I acknowledge and accept the potential risks in the activities or services provided.
